1. Acceptance of Terms
By creating an account or using BidWatchHQ ("the Service"), you agree to these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these terms. If you do not agree to these terms, do not use the Service.
2. Description of Service
BidWatchHQ provides:
- Daily monitoring of federal government procurement opportunities via SAM.gov
- AI-generated plain-English summaries of contract solicitations
- Relevance matching based on your NAICS codes, certifications, keywords, and preferences
- Daily email digests of matched opportunities
- Urgent deadline alerts for opportunities closing within 72 hours
The Service currently covers federal procurement opportunities. State-level contract coverage is in development and not guaranteed to be available on any specific timeline.
BidWatchHQ is an information and notification service. We do not submit bids on your behalf, provide legal advice, or guarantee contract awards.
3. Accounts
You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at kyle@bidwatchhq.com if you suspect unauthorized access.
You may not create more than one account per business entity, share your account with others, or use the Service for any purpose other than your own business's government contracting activities.
4. Free Trial
New accounts receive a 30-day free trial with full access to Starter plan features. No credit card is required to start your trial. At the end of the trial period, your account will be downgraded to an inactive state unless you subscribe to a paid plan. We will send you a reminder before your trial ends.
5. Subscriptions and Billing
Plans and pricing: Subscription plans and pricing are listed at bidwatchhq.com/pricing. Prices may change with 30 days' notice to active subscribers.
Billing cycle: Subscriptions are billed monthly on the anniversary of your subscription start date. Payments are processed by Stripe.
Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial months.
Failed payments: If a payment fails, we will retry and notify you by email. If payment is not resolved within 7 days, your account may be suspended until payment is made.
6. Acceptable Use
You agree not to:
- Use the Service to scrape, copy, or resell contract data to third parties
- Attempt to reverse-engineer, hack, or interfere with the Service
- Use the Service for any unlawful purpose
- Share your account credentials with others
- Use automated tools to access the Service in ways that disrupt normal operations
- Misrepresent your business certifications or qualifications in your profile
We reserve the right to suspend or terminate accounts that violate these terms.
7. Intellectual Property
BidWatchHQ owns all rights to the Service, including the platform, matching algorithms, AI summarization systems, and original content. Government contract data sourced from SAM.gov is public domain information provided by the U.S. federal government.
AI-generated summaries produced by the Service are provided for your business use. You may not resell or redistribute them.
8. Data Accuracy and Disclaimer
Contract data is sourced from SAM.gov and processed daily. While we strive for accuracy and timeliness, we do not guarantee that:
- All relevant opportunities will be captured and delivered
- AI summaries are error-free or complete
- Relevance scores accurately reflect your eligibility
- Deadline alerts will be delivered before a closing date in all cases
Always verify opportunity details directly on SAM.gov before submitting any bid or proposal. BidWatchHQ is a discovery and notification tool, not a substitute for your own due diligence.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, BIDWATCHHQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR CONTRACT OPPORTUNITY WILL BE IDENTIFIED OR DELIVERED.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BIDWATCHHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST CONTRACT OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold BidWatchHQ harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we discontinue the Service. We will provide reasonable notice before terminating accounts in good standing. Upon termination, your access to the Service ends and your data will be deleted per our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
